Terms of Service
The rules for using Bonga One — for donors and for the NGOs we serve.
Last updated: October 29, 2026. Plain-English summary in each section heading; the full text below is what governs.
1. About these terms
These Terms of Service ("Terms") govern your use of Bonga One, a donation-gateway platform operated for non-governmental organisations ("NGOs") in South Sudan. By making a donation through a Bonga One widget, or by operating an NGO account, you agree to these Terms. If you do not agree, do not use the platform.

2. What Bonga One does — and does not do
Bonga One is an aggregator and payment facilitator. We collect donations on behalf of registered NGOs by card through Stripe (our payment processor) and settle them to the NGO's verified KCB bank account when the NGO requests a withdrawal, minus our platform fee. When you donate, your funds are collected by Bonga One on behalf of the NGO you chose.

Bonga One is not a charity, not the recipient of your gift in its own right, and not a bank. We do not endorse, audit the programmes of, or guarantee any NGO's work. The NGO is solely responsible for how donated funds are used.

3. Eligible use
You may use Bonga One only for lawful charitable donations. You must not use the platform to move funds for unlawful purposes, to launder money, to circumvent sanctions, or for any transaction unrelated to charitable giving. We may refuse or reverse any donation that appears to breach this section.

4. NGO responsibilities
- Lawful funds. Funds you receive through Bonga One must be applied to your lawful charitable mission.
- Accurate organisation information. Your legal name, registration details, website and contact details must be accurate and kept up to date.
- KCB account ownership. The bank account you register for payouts must belong to your organisation and must be a KCB account denominated in your settlement currency. Withdrawal funds are sent only to that verified account.
- Verification documents. You must provide the KYC documents we request and keep them current.
- Donor communications. Donation receipts are issued through Bonga One; any further donor engagement is your responsibility.
NGO accounts on Bonga One are created by our administrators. Providing an account, widget or payout access does not constitute an endorsement of your organisation.
5. Donor terms
- Donations are final except where our refund policy (section 7) applies. A donation is a voluntary gift to the selected NGO — it is not a payment for goods or services, a deposit, or an investment.
- How payment works. Card details are entered in payment fields hosted by Stripe inside the donation widget; card data is not visible to Bonga One or the NGO's website. The payment completes without leaving the page.
- Fee-covered option. Before confirming a donation you may choose to add the platform fee on top of your gift ("cover the fee"), so the NGO receives the full amount. If you decline, the fee is deducted from your donation. The choice and the exact totals are shown before you pay.
- Receipts. A digital receipt with a unique reference is issued for every completed donation and available at the public receipt link shown after payment.
- Amount limits. Donations must be between $1.00 and $500,000.00.
Tax treatment varies. Bonga One does not determine whether any donation is tax-deductible — that depends on the receiving organisation and your own tax jurisdiction. Ask the NGO directly.

6. Fees
Bonga One charges a platform fee on each donation. The default fee is 2.50% of the donation amount, with a minimum fee of $0.30. A specific widget may show a different percentage — the fee that applies to your donation is the one displayed in the widget before you pay, and it is fixed at donation time: later changes to any fee configuration never affect donations already made.
7. Refunds
Donations are held for a 7-day refund window before they become eligible for payout to the NGO. This window lets genuine problems (unauthorised payments, duplicate donations, mistaken amounts) surface.
Refunds in version 1 of the platform are a policy-level process initiated by the NGO or by Bonga One — there is no self-service donor refund button. Contact the NGO first, or reach us at admin@bongaone.test with your receipt reference. A refund returns the donation amount as processed; where the fee was deducted rather than covered, the fee component is handled according to the specific refund decision. Donations already released in a payout are refunded only by agreement with the NGO.

8. Payouts and withdrawal of funds
Cleared donations (those past the refund window), minus platform fees, remain visible as an eligible balance in the NGO dashboard. Funds are released when the NGO requests a withdrawal: the request creates a payout for the selected transactions in the currency of the NGO's verified KCB bank account, Bonga One administrators review it, and payouts at or above our internal approval threshold are released only after review by two distinct authorised reviewers. Approved payouts are disbursed by KCB bank transfer to the NGO's verified KCB account, and a statement is available in the NGO dashboard.
9. Suspension and termination
We may suspend or close an NGO account — and stop processing its donations — if it breaches these Terms, fails verification, is suspected of unlawful activity, or for legal/compliance reasons. Donations for an active widget stop being accepted the moment a widget or organisation is suspended.
10. Liability
Bonga One provides the platform "as is". To the maximum extent permitted by law, we are not liable for indirect or consequential loss, for the use to which an NGO puts donated funds, or for losses caused by events outside our reasonable control (including payment-rail outages). Our total liability arising out of any donation is limited to the platform fee on that donation.

11. Changes to these terms
We may update these Terms from time to time. The "last updated" date above shows the current version. Material changes affecting fees or refunds will be reflected on this page before they take effect.
12. Governing law
These Terms are governed by the laws of the Republic of South Sudan, without prejudice to any mandatory consumer-protection rules that apply to you.
[LEGAL REVIEW] — governing law and dispute-resolution clause to be confirmed by counsel.
